The Setting
Marking their first three-day auction since the tumultuous times of the financial crash in 2008, Allsops prepared for a big event. With 505 lots up for grabs pre-auction, and 21 of them guided at £1m or above, this was a clear reflection of the built-up supply and demand during the summer months.
The first day was a hybrid auction with the live version set in the plush interiors of The May Fair Hotel in London. The subsequent two days were online-only.
&nbsp;
Insider’s Take
Having attended the in-room auction, I can vouch for the palpable energy. 144 properties were snagged, accumulating a whopping £44mil and a robust 78% success rate.<a href="https://www.theaic.co.uk/aic/news/citywire-news/distressed-home-reit-sells-137-properties-for-a-third-of-what-it-paid" target="_blank" rel="noopener"> Home REIT sales</a> comprised the majority of sales in the subsequent online-only days.

The online leg concluded with sales of 159 properties, generating £20mil and a remarkable 91% success rate.
&nbsp;
The Bigger Picture
To appreciate the magnitude of this event, one needs to understand Allsops&#8217; journey in recent times. Typically, they&#8217;d host around 8 auctions annually. While the pandemic thrust them into an online-only model, recent attempts to revive in-room auctions saw mixed success. This three-day auction, a strategic blend of offline and online experiences, is a testament to their adaptability.
Also noteworthy is their year-to-date performance: £301mil in sales, 502 lots sold, an average success rate of 89%, and the successful sale of 77 high-value properties, each guided at £1mil or above.

A Litmus Test for the Market
The last time a three-day event occurred was amid the 2008 financial crash, making this a strategic maneuver in response to current market conditions.
In a year where they’ve been experimenting with auction formats &#8211; attempting multiple in-room auctions, some of which got canceled, and balancing it with their online model &#8211; this event was a testament to their resilience and ability to adapt.

🎙️Sunday Special Episode 131: Navigating the Uncertainty: Discussing Rates, Stock Decisions, and the Economy - Hammered

Now, I always stress the importance of industry knowledge and the ability to think outside the box. Well, today I&#8217;m going to recount a story that underscores just how critical those two factors can be. This one&#8217;s about a seemingly impossible feat we pulled off at <a href="https://auctionbuyers.club/">Auction Buyers Club</a>, and I think it&#8217;ll both educate and inspire.
Here&#8217;s the thing: It&#8217;s virtually unheard of to purchase a receivership property before it goes to auction. Why? Because receivers have a strict duty to ensure they obtain the best possible price for a property. Auctions are viewed as the open market mechanism to establish this price. Essentially, they&#8217;re playing it safe to avoid being legally pursued later. But what if we managed to do the unthinkable?
Picture this: I stumbled upon a property in an auction catalogue close to my childhood home. My intuition and a good old Google search led me to a golden discovery – an adjacent house for sale, that had planning permission for both properties to be converted into seven flats. A developer&#8217;s dream if they could get both. But <a href="https://www.strettons.co.uk/auctions/current-catalogue/">Strettons, the auction house</a>, were only auctioning one.
Then, like a scene from a movie, Kimberly Rothman from Auction Buyers Club reached out. She already had her eyes set on both properties and was looking to secure them before auction day.
Now, given the strict rules around receivership sales and the tight timeline (just 7 days till auction!) This was a Herculean task.
Piotr and I set to work.
Diving deep, we managed to trace the owners on Facebook and discovered their Polish descent. Leveraging Piotr&#8217;s Polish roots, we were able to establish an initial connection, making our approach more genuine. Piotr emphasised how the value of both properties would skyrocket if sold together. She got it. The husband? Well, amidst the chaos of a pending divorce and the sting of foreclosure, he was harder to convince.
Given the couple had already demonstrated the intelligence to obtain the planning permission in the first place , we were confident the husband would ultimately come round. And he did.
With the couple on our side, we gave them a crash course on how to communicate the potential financial benefits to the Receivers. It was crucial to drive home the point that selling both properties to a developer was not just beneficial, but the most financially prudent decision.
And then, the looming challenge – the bank. Knowing the couple&#8217;s debt ranged between £20,000 to £30,000, we crafted a strategy: increase the on-paper sale price of the Receivership property by £50,000. This would cover both the debt and the receivership fees. It was a win-win: The bank and the Receivers would meet their fiduciary responsibilities, ensuring they had achieved the best value and shielding them from any future legal repercussions. This manoeuvre was instrumental in getting the bank&#8217;s nod.
Of course, it wasn&#8217;t just about the owners or the bank. Strettons, the auctioneers, played a crucial role. We worked tirelessly to build trust, ensuring they had everything they needed for a seamless transaction.
The final hurdle? Structuring the deal ensuring the synchronised acquisition of both estates before auction day.
To do this, we arranged an option agreement for the second property, granting Kimberly the right to purchase it contingent on her successful acquisition of the auction property. This agreement was woven into the exchange of contracts. (With special thanks to <a href="https://www.linkedin.com/in/george-crofts-063434210/?originalSubdomain=uk">George Crofts</a>, Kimberly’s solicitor, without whom it simply wouldn’t have been possible!)
And after some high-stakes negotiations and a bit of finesse, Kimberly closed the deal on both properties, for a total of £1.1m. A price she was very happy with.
So, what&#8217;s the takeaway here?
Even in a world dictated by strict rules and regulations, with the right knowledge, creative thinking, and a splash of audacity, you can bend those rules to your advantage.
Remember, every challenge is an opportunity in disguise. If you ever find yourself facing a brick wall, don&#8217;t hesitate to think outside the box, or better yet, redefine the box.

1/ Hey Twitter! Just had a fascinating conversation with a cash buyer who has had a whopping 1100 leads this month! 😱  They&#8217;ve managed to complete on 23 properties already. Impressive, right? But here&#8217;s the kicker &#8211; we&#8217;re negotiating on the same portfolios. 2/ So this cash buyer is offering more money and has an extensive network, which allows them to quickly move deals onto others. I was intrigued, so I asked how they sifted through all the time wasters and unmotivated sellers. They said simplicity is key. 👥

3/ They like having two options when making deals &#8211; a cash offer or a conditional offer subject to planning. It&#8217;s a simple approach that doesn&#8217;t overcomplicate things. Of course, the number of offers might vary depending on the situation, especially with mixed commercial portfolios. 🏢📜

4/ Speaking of portfolios, I recently came across a Facebook post about a portfolio sale in the northeast area. It consists of 2 to 5 rented <a href="https://www.gov.uk/house-in-multiple-occupation-licence" target="_blank" rel="noopener">HMOs</a>, single contained units, and blocks of flats. The current rent roll is around £150,000, and the seller is asking for £2.5 million. 💼💰

&nbsp;
5/ My suggestion to the seller was to fully let the portfolio and increase rents before selling. Plus, I questioned their reason for selling and suggested that selling the assets individually might fetch a better price. Sometimes, taking a step back can bring greater rewards. 📈💸

6/ Ethics and fairness are crucial when conducting deals. I recently negotiated a deal with someone who needed a deferred payment plan to secure their future generations financially. It&#8217;s important to consider the long-term impact and ensure everyone involved is treated fairly. 💼🤝

7/ Let me take a moment to reflect on market conditions. Remember Brexit? The pandemic? They all affected vendor motivations. It&#8217;s crucial to understand the risks and decision-making involved, especially when considering selling at auction. Vendors must be realistic with their expectations. 🌍🤔

8/ On the topic of undervalued assets, I&#8217;ve experienced transactions where the value might not have been accurately reflected. One time, I bought a reefer for 30,000, refurbished it, and saw its value increase. It&#8217;s all about spotting opportunities and maximizing potential. 📉💡

9/ But let&#8217;s not forget the importance of proper due diligence and legal advice. Solicitors should fulfill their duty to clients, considering factors like declarations of solvency and definitions outlined in the red book. Cash transactions may result in lower prices compared to mortgages. 🏦💔

11/ Now, let&#8217;s talk about buying a business &#8211; should we focus on its current value or its potential future value? Early stage investments in AI companies have created bubbles in the market, distorting dynamics. It&#8217;s crucial to assess risks properly and not just follow trends. 📈🤔

12/ The focus on AI is hot right now, but is it just another trend or a legitimate opportunity? Let&#8217;s not forget how some investors only chase the next big thing, like cannabis a few years ago. Understanding the target audience and properly assessing risks are essential. 💼🌱

THREAD: The UK housing market is correcting, not crashing. As I&#8217;ve been advising, it&#8217;s still a good time to invest, especially outside of London<a href="https://www.bbc.co.uk/news/uk-politics-55819489" target="_blank" rel="noopener"> in Freeport areas </a>and regeneration projects. But beware of 2-year products with high fees.
&nbsp;
&nbsp;
It&#8217;s concerning that not enough people are warning against these products. The market trends from ‘87 to ‘94 show that high mortgage rates and <a href="https://en.wikipedia.org/wiki/Mortgage_interest_relief_at_source" target="_blank" rel="noopener">the withdrawal of MIRAS</a> led to a correction in the housing market. But prices are still 5% above where they were at the start of the pandemic and will take a few years to reach pre-pandemic levels.
&nbsp;
&nbsp;
Political policies also play a role in the housing market, and affordability is becoming the only argument left as supply and demand has become problematic. The Bank of Mom and Dad is propped up by housing prices. Meanwhile, banks need to pay more for their role in the financial crisis and infrastructure needs funding. A windfall tax is likely to be levied.
&nbsp;
&nbsp;
There&#8217;s frustration with radio presenters and professors who &#8220;don&#8217;t bloody know what they&#8217;re talking about.&#8221; The mortgage crisis and landlords being forced to raise rents to market value need addressing, and the Bank of England needs to address the issue by sacking the governor.
&nbsp;
&nbsp;
Communication during the crisis has also been lacking.
&nbsp;
&nbsp;
Overall, we need a financial refresh focused on labor policy, green investment, and legislation to enforce investment in green products. We need proper statistics and mathematicians, better mortgage products, financial incentives for green growth, and a focus on recruitment and giving people jobs. Let&#8217;s move the world forward.

1/ Money laundering and efficient investments &#8211; these are what today&#8217;s podcast episode is all about. Let&#8217;s dive into the highlights.
2/ Bridging margins have been squeezed to a very narrow point due to the risk-free rate of return on money. Banks hold onto old debt with low rates because it is attached to their margins.

7/ It&#8217;s important to stay in one&#8217;s lane and focus on their expertise, but also bring in others to fill skill gaps. Letting agents and property sources must use compliant client accounts to hold funds.
8/ The construction industry is heavily regulated for taxes but there is still incentive to cheat outside of the system. Personal accounts are used to receive rent payments but it&#8217;s important to have an audit trail and record the payments.
9/ Survey results show that 50% of surveyors are reporting decreasing prices in their areas, while 35% are seeing increasing prices. This is a leading indicator for market trends.

At Hammered we review thousands of auction properties each year, so you can bet we&#8217;ve seen it all when it comes to legal packs and addendums. Today, I&#8217;ll be sharing with you my top three red flags to look out for when you&#8217;re combing through those hefty documents.

First, let me emphasise that while the legal pack and the addendum are crucial tools for decision-making, they are just two parts of the picture. The <a href="https://hammeredauctions.co.uk/auction-academy/property-auction-london" rel="noopener">property auction</a> game is not for the faint-hearted. A successful purchase requires comprehensive due diligence, and relying solely on the information from the catalogue, website, legal pack or addendum is not enough.
&nbsp;
&nbsp;
Now, when do we typically expect the legal pack to be available? Well, ideally, it should be available on the day of the second viewing. However, this isn&#8217;t always the case. Depending on who the seller is, such as banks or local authorities, the legal pack can be available from the point of instruction or all the way up to the start of the auction.
&nbsp;
&nbsp;
So, without further ado, let&#8217;s jump right into the three red flags I always keep an eye out for.

Buying a Property at Auction? Look Out for These 3 Legal Pack Red Flags
&nbsp;
&nbsp;
1. Non-standard completion time
&nbsp;
&nbsp;
Our first flag is related to timing. Normally, a standard completion time is twenty working days, or twenty-eight if you include weekends. If the seller is a bank or an LPA receiver, or it&#8217;s a probate sale, I&#8217;d expect a shorter time, typically ten to fourteen days. Similarly, small land purchases should have a shorter completion time. If the timing deviates from these norms, I&#8217;d be inclined to dig deeper.

2. Non-standard deposit amount
&nbsp;
&nbsp;
Next up is the deposit amount. A standard auction deposit is 10 percent. If the required deposit is higher than this, that&#8217;s a red flag for me. In such cases, I&#8217;d recommend conducting additional research into the seller and assessing your risk exposure for the deposit.

&nbsp;
3. Exclusion of the notice period
&nbsp;
&nbsp;
Lastly, an exclusion of the notice period is something I would find concerning. Under common auction conditions, a ten-day notice period is granted if the buyer fails to complete on time. Some sellers, however, may reduce this to between five to seven days, or even remove it entirely. While there may be valid reasons for this, I believe it&#8217;s essential to find out why. Usually, it&#8217;s linked to their motivation for selling.

&nbsp;
These are clauses or stipulations that always make me think twice about proceeding. That doesn’t mean that I won’t proceed; it will just induce me to dig a little deeper before I do!
&nbsp;
&nbsp;
Bear in mind that a typical legal pack is released one to two weeks before the auction. Going through it can not only save you from potentially costly mistakes but also help you ask your solicitor the right questions, ensuring you make the most commercial sense of your purchase.

There might be a large pool of people whose jobs are at risk of being replaced by AI, while there is still a massive shortage of workers who can do manual jobs.</li>
<li>Freedom of speech and personal responsibility are crucial elements that influence various aspects of life, including property. Political events and social issues, such as student debt and social housing, are interlinked with property.</li>
<li>The cost of delivering housing has been a big failing since the 1980s, with the cost of delivery too high compared to the rent they can charge. The introduction of local governmental departments into the property market would have a negative impact on the property prices.</li>
<li>Customer satisfaction is based on expectations vs. delivery and can vary greatly between different types of businesses. Highly satisfied customers are a key factor in the success of top businesses. AI can potentially improve tenant satisfaction scores, but there are limitations, such as difficulty in diagnosis and changing tenant behaviours.</li>

🔥 In light of the pandemic, we&#8217;ve seen the economic impact on the housing market and interest rates, both in the UK and the US. While the US has taken a run at an express train approach, the UK is expecting higher interest rates in the near future.
🔥This higher rate environment could last longer than expected, so it&#8217;s crucial to sort out debt and not wait for rates to come back down. We must also be careful about relying on lending money to property groups, as this can be risky.
🔥 Jordan Peterson encourages us to think about equality of opportunity, not just equality of outcome. Rather than indoctrinating or virtue signalling, effective communication and open discussion are essential to persuade people.
🔥 There are also concerns about fairness and upsetting people in today&#8217;s society. We must understand how to communicate effectively with different people, including understanding the five-year debt cycle that is commonly used in the UK.
🔥 While there are ethical concerns, it&#8217;s important to recognise that free market dynamics inevitably lead to exploiting niches for profit. Tax incentives could be a potential solution, but the political climate is not favorable to this.
🔥 Ultimately, the EU&#8217;s political and economic union is doomed to failure. Germany, for example, has historical reasons for wanting to be closer to its neighbours and not be put at risk by other world superpowers.
🔥 Though failure can be viewed as unfair, we must focus more on the reality and metrics of a situation. If a venture capitalist buys a struggling company and lays off 80% of the workforce to keep it afloat, we should scrutinize the reality of the decision rather than its fairness.
🔥 We must shift our focus back to objective numbers and metrics, rather than a global focus on fairness. Let&#8217;s take steps towards building sustainable and successful businesses that we can be proud of.
